Each section of the list is presented separately, along with the relevant provision of the 2014 OECD recommendation on international cooperation in competition investigations and procedures, as well as a list of relevant clauses in the 15 bilateral cooperation agreements. If necessary, the list of relevant clauses contains provisions contained in five second-generation agreements (i.e. agreements with provisions allowing, in certain circumstances, the exchange of confidential information without the prior consent of the source of the information) as well as two specific positive cooperation agreements. Regional Competition Agreements: Benefits and Challenges, General Information, OECD Policy Roundtables From August 2020, more than 2,500 bilateral exchange relations have been activated for jurisdictions that commit to cbC reports, and the first automatic exchange of cbc reports took place in June 2018. These include exchanges between the 88 signatory states of the EU Competent Authority Convention, the CNC, between EU member states under the 2016/881/EU Directive and between signatories to bilateral agreements to exchange exchange agreements of competent authorities under double taxation agreements or exchange of tax information, including 41 bilateral agreements with the United States. Legal systems continue to negotiate CBC reporting agreements and the OECD will issue regular updates to clarify things for MNE groups and tax administrations. Regional trade agreements (RTAs), which consist of bilateral and multi-lateral trade agreements, free trade agreements, economic partnerships and other trade liberalization agreements between countries, have increased significantly over the past decade. Countries are increasingly using these trade agreements for environmental cooperation by integrating environmental legislation into the RTA. Most trade agreements include a chapter on competition policy or individual competition rules.
These relate to a number of issues such as the adoption or maintenance of competition law, international cooperation in competition policy or the introduction of procedural safeguards. The head of the NEA Office of Legal Counsel performs filing functions on behalf of the OECD Secretary General for various international agreements. As part of this work, the OECD Competition Committee has compiled an inventory of international cooperation agreements.
